THE HONOURABLE Dr.JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.24962 of 2016 ORDER :
This writ petition is filed under Article 226 of the Constitution of India, seeking the following relief: " ..to issue any writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondents herein in not delivering possession of the lands by executing sale deed in respect of lands admeasuring 180 sq.yards in Plot No.9, Block No.25, Autonagar, Hyderabad as per the proceedings in Letter No.272/ ADO/ ANH/ HATU/ 83, dt.10-07-1983 as illegal, arbitrary, null and void and or a consequential direction to the respondents to execute a sale deed in favour of the petitioner in respect of the lands admeasuring 180 sq.yards in Plot No.9, Block No.25, AILA, Autonagar, Hyderabad and to pass such other order and further orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."
Heard learned counsel for the petitioners and Sri L.Prabhakar Reddy, learned Standing Counsel appearing for respondents and perused the prayer in the writ petition with supporting affidavit, counter-affidavit and reply affidavit and the enclosed documents on record.
In fact, there are certain disputed questions of fact from the material and this Court is not in a position to adjudicate, though mere involvement of factual questions in dispute is not a bar, to maintain the writ petition.
Having regard to the above, there is no need to go into the merits, but for, to relegate to approach proper Civil Court for the effective remedy.
Accordingly, the Writ Petition is disposed of at the stage of admission. No costs.
Consequently, miscellaneous petitions, if any, pending shall stand closed.
