THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.28103 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a writ of mandamus in not allotting shops in Rythu Bazar, Saroornagar to the petitioners as illegal and arbitrary.

2. Heard the learned counsel for the petitioners and learned Standing Counsel for respondent Nos.1 to 3.

3. At the time of arguments, learned standing counsel, on instructions, submitted that there remain eleven (11) shops in Rythu Bazar, Saroornagar without allotting to anybody. She further submitted that the respondents will allot the same, in the near future, by following draw system. Thus, as on today, eleven shops are vacant.

4. Having regard to the facts and circumstances of the case, the respondents are hereby directed to issue fresh notice before allotting the shops. The petitioner Nos.1 to 11 are at liberty to participate in the draw.

5. With the above direction and observation, the writ petition is disposed of. Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
