HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 32172 of 2018 ORDER:

1) Heard learned counsel for the petitioner and learned Government Pleader for Revenue. With the consent of both the parties, the Writ Petition is disposed of at the admission stage itself.

2) The present Writ Petition came to be filed seeking issuance of writ of mandamus declaring the proceedings of the fourth respondent in letter No.23/17/A, dated 11.10.2017, wherein he refused to make correction of the record of rights by inserting the name of the petitioner in respect of the land admeasuring Acs.3.54 cents in Survey Nos.269/7, 268/2, 268/3, 267/4, 267/3 and 269/4 of Patha Bobbili village, Bobbili Mandal, Vizianagaram District, as illegal and arbitrary.

3) At the time when the matter is taken up for hearing, it is brought to the notice of this Court that against the order of the Tahsildar - respondent No.4, dated 11.10.2017, an appeal came to be filed before the Revenue Divisional Officer, but no written orders came to be passed in the said appeal. 4) Learned Government Pleader would submit that if the appeal filed by the petitioner is still pending consideration,

the authorities would pass orders by taking into consideration the documents filed.

5) Having regard to the above, the Writ Petition is disposed of directing the Revenue Divisional Officer - respondent No.3 to pass appropriate orders in the appeal filed by the petitioner, against the order of the Tahsildar dated 11.10.2010, in letter No.23/17/A, taking into consideration the registered sale deed dated 11.08.1966 and the contents therein and also by giving an opportunity of personal hearing to the petitioner and all concerned, if not already passed, as early as possible, preferably within a period of four to six weeks from the date of receipt of a copy of the order, in accordance with law. In case order is already passed, the authorities concerned shall forthwith communicate a copy of the the order to the petitioner. 6) Miscellaneous petitions, pending if any, shall stand closed in the light of this final order.
