THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M.GANGA RAO WRI T PETI TI ON No.32914 OF 2018 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) The petitioner is the unsuccessful applicant in O.A.No.2017 of 2015 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad. His prayer therein was to declare the action of the authorities in not fixing his service pension as illegal. By order dated 29.11.2017, the Tribunal dismissed the O.A.

Perusal of the order under challenge reflects that the petitionerapplicant was appointed as a Village Revenue Officer on 04.05.2008. He attained the age of superannuation in May, 2013. He therefore did not put in requisite qualifying service to get pension. His claim however is based not on the date of his actual appointment but on the date of his so-called entitlement to be appointed.

It is an admitted fact that the petitioner-applicant earlier filed O.A.No.5907 of 2008 seeking regularization of his services with effect from 04.09.1987 to 04.05.2008 and the said O.A. was dismissed by the Tribunal vide order dated 29.03.2011. In effect, the petitioner-applicant's services can only be reckoned from 04.05.2008 and from the said date, he did not have the requisite qualifying service to seek the benefit of pension. The order of the Tribunal holding to this effect does not warrant interference either on facts or in law.
