This Criminal Petition is filed by the petitioner- A1 under Section 438 Cr.P.C. seeking to grant anticipatory bail to him in Crime No.246 of 2015 on the file of Haliya Police Station, registered for the offence punishable under Sections 448, 323, 504, 506 r/w 34 IPC and 3(1)(x) of the SCs & STs (POA) Act.
Heard and perused the material available on record. It is alleged that the de facto complainant gave Rs.15,000/- to the petitioner-A1 three years back and on 15.12.2015 when she went to the house of A1, A1 and his wife abused her in filthy language and they beat her and she went to the police station for giving the complaint against A1 and thereafter, when she came back to home, the other accused including the petitioner beat her and abused her touching the name of her caste.
Considering the facts and circumstances of the case and the nature of the offence, this Court is inclined to pass the following order: The petitioner-A1 is directed to surrender before the Court concerned and file an application for regular bail. On such application being filed, the Court concerned shall consider the same on the same day in accordance with law.
