ORDER:

The Criminal Revision Case is filed against the issuance of NBW on 10.02.2016 in S.C. No.13 of 2015 on the file of Assistant Sessions Judge at Nellore, S.P.S.R Nellore District.

2) Heard learned counsel for petitioners/ A.1 and A.2 and also learned public prosecutor representing State of Andhra Pradesh before admission and perused the material on record. 3) It is submitted that the issue in the present matter is covered by the order of this Court in Crl.R.C. No.988 of 2017 dated 10.04.2017 and the said order reads as follows: " The revision is disposed of before admission by directing them by filing application under Section 44 of Cr.P.C to surrender before the learned Magistrate and because the bail order is in force and not cancelled either under Section 439

(2) of Cr.P.C or Section 437 (5) of Cr.P.C., from the bail order in force, the only thing is to impose penalty on the bonds earlier executed by forfeiting the bonds and to obtain fresh bonds on payment of penalty by accused without insisting the earlier sureties to pay any further penalty and in the event of payment of such penalty to be imposed and fresh bonds to be executed to release pursuant to the earlier order in force." 4) Following the above said order and for the reasons recorded therein, the Criminal Revision Case is also disposed of with the terms thereof and it is made clear that in the event of payment of fine by the accused, the sureties again need not pay.

5) As a sequel, miscellaneous petitions if any pending shall stand closed.
