ORDER:

Challenging the inaction of the 2nd respondent in disposing of the appeal filed by the petitioners on 09.09.2015 against the order of confiscation of the 3rd respondent dated 22.06.2015 confiscating two Tipper vehicles bearing Nos.AP 12V 0243 and AP 28V 3376 along with material, the petitioners filed the present writ petition. Heard learned counsel for the petitioners and learned Government Pleader for Forests.

Having regard to the fact that against the order of the 3rd respondent confiscating the vehicles along with the material the petitioners had already availed the alternative remedy of appeal before the 2nd respondent, I am of the view that without entering into the merits of the matter the writ petition can be disposed of with a direction to the 2nd respondent to dispose of the appeal within a time frame. Accordingly, the writ petition is disposed of directing the 2nd respondent to dispose of the appeal preferred by the petitioners in accordance with law, after giving an opportunity of hearing to them, as expeditiously as possible preferably within a period of six weeks from the date of receipt of a copy of this order.

As a sequel, pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
