THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6302 OF 2016 ORDER:
This petition is filed by the petitioner-accused under Section 482 Cr.P.C. seeking to quash the proceedings against him in C.C.No.706 of 2015 on the file of the XVIII Additional Chief Metropolitan Magistrate, Erramanzil, Hyderabad. Heard and perused the material available on record. The petitioner is alleged to have committed the offence punishable under Sections 138 and 142 of the Negotiable Instruments Act.
Considering the facts and circumstances of the case and the nature of the offence, this Court is not inclined to interfere with the proceedings in the above case.
At this stage, the learned Counsel for the petitioner has prayed for dispensing with the presence of the petitioner before the trial Court. In view of the above submission, the presence of the petitioner before the trial Court is dispensed with, except on the dates when his presence is specifically insisted by the trial Court. The petitioner is directed to be represented through a Counsel before the trial Court on all hearing dates.
