THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.1765 OF 2016 ORDER:

This petition is filed by the petitioners-accused Nos.2 and 3 seeking to quash the proceedings against them in C.C.No.25 of 2015 on the file of XV Additional Chief Metropolitan Magistrate, Hyderabad, The 2nd respondent is the wife of A1 in the above C.C. The 1st petitioner is the mother-in-law and the 2nd petitioner is the sister-in-law of the 2nd respondent. The petitioners are alleged to have committed the offence punishable under Sections 498-A r/w 34 IPC and Sections 3 and 4 of the Dowry Prohibition Act.

Considering the facts and circumstances of the case and the nature of the proceedings, this Court is not inclined to interfere with the proceedings in the above C.C. At this stage, the learned Counsel for the petitioners prayed for dispensing with the presence of the petitioners before the Court below.

In view of the request made by the learned Counsel for the petitioners, the presence of the petitioners-A2 and A3 before the Court below is dispensed with, except on the dates when their presence is insisted by the Court below.

With the above direction, the Criminal Petition is disposed of. Consequently, the Miscellaneous Petitions pending, if any, shall stand closed.
