HON'BLE SRI JUSTICE S.V.BHATT W.P.No.10791 OF 2012 ORDER:

The petitioner prays for the following relief: "..to issue a suitable writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of the Respondent in interfering with the manufacturing and sale of our bioproducts like Cytostim-Gr, Humic Plus 5-G, Rule, Demand, Cytostim- L , Cytovit- S P , Humic Plus-L, Humic Plus-P, Bio-Alpha, Bio-Force-P, Mega Punch, Mega Stick, Nutrimycin, Bio Flash-F, Tiger, Nitro Plus and Mega Force, Which contains Amino Acid and See-Weed Extract, by issuing Memo No.PP.II (1)2085/2005, dated 21.01.2006 and letter No.PP.II(1)2085/2005, dated 21.01.

2006 as being illegal, arbitrary, unconstitutional constitutional and without jurisdiction and further direct the respondent not to interfere with in any manner in the manufacture, sale and distribution of our bio-products including from the licensed premises of the dealers/stockists under the Insecticides Act,1968 and the Fertilizers Control (Order) Act, 1985.." The subject matter of the writ petition is covered by the order of this Court dated 29.12.2011 in writ petition No.34480 of 2011. The writ petition is disposed of on the same lines. No order as to costs.

It is made clear this Court has not considered the merits of the assertion of the petitioner and is not expressing any view on the nature of activity carried on by the petitioner. It is for the authorities to consider and determine.
