HONOURABLE SRI J USTICE SURESH K UMAR K AIT CONTEMPT CASE No. 2529 of 2016 ORDER:

Pursuant to the order of this Court dated 27.12.2016, Sri Hari Narayanan, Commissioner, Greater Visakhapatnam Municipal Corporation, first respondent herein, is present in person before this Court and seeks apology for not complying the order of this Court in time. He submits that vide order dated 20.10.2016, the directions of this Court have been complied with. This Court through order dated 26.08.2016 passed in Writ Petition No. 28671 of 2016 directed the first respondent who is present before this Court to take decision within a period of four weeks from the date of the said order and communicate the same to the petitioner within one week thereafter. Since the said order has not been complied, the petitioner made a representation seeking to implement the order of this Court.

Now it is proved that the first respondent intentionally and deliberately violated the order passed by this Court. More over, if there is any delay in complying the order of this Court, he ought to have moved an application seeking extension of time, which he did not do so. The first respondent sought unconditional apology and the same is accepted by this Court subject to payment costs of Rs.25,000/-, which shall be paid by the first respondent through cheque to the petitioner within one week from today.

the costs of Rs.25,000/- imposed by this Court, the first respondent shall bear Rs.5,000/- from his own pocket. Subject to the above, the Contempt Case is disposed of.
