Heard learned counsel for the petitioner and the Government Pleaders for Excise and Home, appearing for the respondents.

As against the order, dated 19.07.2018 in Cr.No.39(5)/2018/P&Ex/2018, of the Deputy Commissioner of Prohibition & Excise, Adilabad-third respondent herein, rejecting the application of the petitioner herein for release of the subject commodity, petitioner herein filed an appeal on 31.07.2018 before the Commissioner, Department of Prohibition & Excisesecond respondent herein and the said appeal is pending consideration till date.

Since the petitioner herein already availed the alternative remedy and the appeal, filed by him, is pending consideration, this Court deems it appropriate to dispose of the Writ Petition, with a direction to the Commissioner, Department of Prohibition & Excise-second respondent herein to pass appropriate orders on the appeal, dated 31.07.2018, said to have been filed by the petitioner herein, within a period of three weeks from the date of receipt of a copy of this order, and communicate the same to the petitioner herein.

Accordingly, Writ Petition is disposed of. There shall be no order as to costs.

As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
