THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.7665 OF 2017 ORDER:

Heard learned counsel for the petitioner/accused of Crime No.152 of 2017 on the file of Station House Officer, Nuzividu Town Police Station and the learned public prosecutor, representing the 1st respondent - State, before ordering notice to the 2nd respondent and perused the grounds urged in the quash petition and the contents of the FIR.

The fact that there is a civil suit pending in relation to the matter in dispute itself is not a ground to quash the FIR. There is nothing in fact to interdict the investigation but for to say some of the penal provisions shown not attracted, however, this is also not a ground to interdict the investigation.

Having regard to the above, this criminal petition is disposed of, while permitting investigation, however, not to arrest petitioner pending investigation. Needless to say, this order will not prevent the police to secure the presence of the petitioner for purpose of investigation.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
