HONOURABLE SRI JUSTICE RAJA ELANGO CIVIL REVISION PETITION No:3787 OF 2016 ORDER:
1. This revision petition is filed by the petitioner seeking a direction to the Principal Junior Civil Judge, Rajahmundry in E.P.No.158 of 2015 in R.C.C.No.27 of 2009.
2. The petitioner herein is the Decree Holder in the above R.C.C. He filed the above E.P. for delivery of the decree schedule property to him or to any authorized person on behalf of the Decree Holder.
3. Learned Counsel for the petitioner submitted that the respondents having suffered with the eviction order in the above R.C.C., are indulging in creating further litigations over the property in question by setting up third party claims to harass the petitioner and therefore, the Court below may be directed to dispose of the above EP as expeditiously as possible.
4. Considering the facts and circumstances of the case and the submissions of the learned Counsel for the petitioner, this Civil Revision Petition is disposed of directing the Principal Junior Civil Judge, Rajahmundry to dispose of E.P.No.158 of 2015 in R.C.C.No.27 of 2009 after hearing both the parties, as expeditiously as possible, preferably within a period of two months from today, in accordance with law. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
