THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.7229 of 2015 ORDER:
The petitioners, while claiming to be the tenants of respondent Nos.3 and 4, state that respondent No.2 - Corporation is trying to demolish the structures occupied by them. They state that a suit was filed by respondent No.3 against respondent No.4 for declaration of title and recovery of possession which was decreed, and an appeal has been filed which is stated to be pending adjudication before this Court.
Sri S.Lakshminarayana Reddy, learned Standing Counsel for respondent No.2 - Corporation, on instructions, submits that the Corporation has not initiated any process for demolition of the subject building, and the Writ Petition is filed on mere apprehension. In view of the submission of the learned Standing Counsel for respondent No.2 - Corporation, the Writ Petition is misconceived. The Writ Petition is, accordingly, dismissed. However, respondent No.2 - Corporation would follow due process of law before taking any action and, thereafter, proceed in accordance with law.
