THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 31869 OF 2017 O R D E R:

This Writ Petition is filed questioning the action of the respondent Nos.3 and 4 for compelling the petitioner to come for private settlement with the 5th respondent.

Heard the learned counsel for the petitioner. The allegations in the Writ Petition are denied by the 3rd respondent. Learned Government Pleader for Home (AP) submits on instructions that allegations are false and there is no harassment to the petitioner. As a matter of fact, as the 5th respondent has made a complaint to the 2nd respondent-Superintendent of Police, who in turn forwarded the same to the Station House Officer, only an effort has been made by the Station House Officer to workout the compromise, if there is any possibility with respect to the complaint made by the 5th respondent against the petitioner. As on date, no FIR is registered and harassment allegations are not correct.

Recording the submissions made by the learned Government Pleader this Writ Petition is disposed of. However, as this is a case of matrimonial dispute the respondent No.3 is directed to strictly comply with the guidelines laid down by the Supreme Court, by its order dated 27.07.2017, in Rajesh Sharma v. State of Uttar Pradesh (Criminal Appeal No. 1265 of 2017). If it comes to light that the 3rd respondent, in the name of investigation, causes any harassment to the petitioner, he shall be liable to be prosecuted in his eo nominee capacity. There shall be no order as to costs.

Consequently, the Miscellaneous Applications, if any shall stand closed.
