THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3484 OF 2016 ORDER:

This petition is filed by the petitioner-accused No.2 under Section 482 Cr.P.C. seeking to quash the proceedings against him in Crime No.204 of 2015 on the file of Women Police Station, Visakhapatnam, registered for the offences punishable under Sections 498-A IPC and 8 of Protection of Children from Sexual Offences Act. The case of the de facto complainant is that she is the wife of the brother of the petitioner, who is A1. It is alleged that A1 used to harass her mentally and physically and he used to misbehave with their elder daughter several times. When she told the same to the petitioner and his wife, instead of warning A1, they pounced upon the de facto complaint and threatened her not to disclose the same to anyone, otherwise they will make her life miserably. Heard and perused the material available on record. A reading of the complaint also discloses that the allegations levelled against the petitioner and the other accused are so serious in nature. Hence, this Court is not inclined to quash the proceedings against the petitioner.

Accordingly, the Criminal Petition is dismissed. However, the petitioner is at liberty to file an application for grant of anticipatory bail before the appropriate Court. Consequently, miscellaneous petitions pending, if any, shall stand closed.
