HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.6310 of 2015 ORDER:
This writ petition is filed by the petitioner with a limited grievance that he has filed an appeal before the 1st respondent on 07.01.2015 under Rule-10 of A.P. (SC, ST and BC) Regulations of Issue of Community, Nativity and date of Birth Certificates Rules, 1997 (for short, 'the Rules), questioning the orders dated 06.12.2015 passed by the 2nd respondent in rejecting to issue SC (Barki) caste certificate to the petitioner, for hearing and not even issued any notices fixing the ate of hearing of the appeal. Hence, the writ petition.
2. The right of appeal being a statutory right under the Act and the petitioner's right cannot be put in jeopardy and make the appeal provision itself nugatory. In that view of the matter, there is an obligation cast on the 1st respondent to pass appropriate orders on the appeal.
3. Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the 1st respondent to dispose of the appeal of the petitioner within a period of four weeks from today, considering the fact that the petitioner is a student, aged 17 years and she needs the certificate to prosecute her education. No order as to costs. Miscellaneous Petitions, if any pending in this writ petition shall stand closed.
