HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WP No.32032 of 2018 ORDER:

This writ petition is filed to declare the inaction of the respondents in taking action on the complaint dated 11-52018 made by the petitioner as being illegal and arbitrary and for issuance for appropriate consequential directions. 2.

It is stated by learned counsel for the petitioner that the petitioner was assigned land to an extent of Ac.2-20 guntas in Sy.No.27/1A situated at Mustipalli Village, Sircilla Mandal, and in that connection disputes arose between the petitioner and the 3rd parties and ultimately the RDO, Rajanna Sircilla District, issued proceedings in favour of the petitioner, but in spite of the same, the respondent-Police are not taking action on his complaint.

3. On the other hand, learned Asst. Government Pleader for Home produced written instructions received in the matter and submits that the respondent-Police have addressed a letter to the RDO, Rajanna Sircilla District, to furnish certain details with regard to the subject land and reply is awaited in the matter. It is further stated that necessary further steps

will be taken in the matter after receipt of information in the matter.

Petitioner's counsel states that the persons named in the complaint have trespassed into the land of the petitioner and planted toddy trees and threatened the petitioner and his family members with dire consequence and the respondentPolice ought to have taken appropriate action on the complaint lodged by the petitioner. In the circumstances, the writ petition is disposed of directing the 3rd respondent to take action on the complaint filed by the petitioner dated 11-052018 by following the guidelines detailed in LALITA KUMARI vs. GOVERNMENT OF UTTAR PRADESH1, if not already followed.
