Heard learned counsel for the petitioner and learned Government Pleader for Revenue (Telangana).

With the consent of both parties, the Writ Petition is disposed of at the admission stage.

The present Writ Petition came to be filed seeking issuance of Writ of Mandamus declaring the action of the third respondent in initiating proceedings No.A/108/2018 and proceeding with enquiry during pendency of suit in O.S.No.53 of 2017, as illegal, arbitrary and violative of Section 8(2) of T.S.ROR Act.

Though various grounds are raised, learned counsel for the petitioner would submit that there is likelihood of the Tahsildar passing orders in favour of the fourth respondent and as such filed the present Writ Petition.

Mere assumption that the Tahsildar is likelihood to pass orders in favour of the fourth respondent, does not entitle the petitioner to file the Writ Petition, questioning the impugned notice, more so, when the petitioner has submitted explanation to the said notice.

Having regard to the fact that the petitioner has submitted explanation to the impugned notice, the Tahsildar shall pass orders, in accordance with law, after hearing all the concerned, as early as possible, preferably within a period of four to six weeks from the date of receipt of a copy of this order. 7.

As a sequel thereto, Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed. No costs. _______________________ C.PRAVEEN KUMAR, J Date: 07.09.2018 vhb
