HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Contempt Case No. 1800 of 2017 Order:

This Contempt Case is filed alleging violation of the orders dated 11.08.2017 passed in W.P.No.27018 of 2017 while issuing notice before admission.

Admittedly, 11.08.2017 happened to be a Friday and there are four consecutive holidays and on 16.08.2017 the demolition took place in violation of the orders of this Court. It is the case of the petitioner that his advocate sent a message around 9.35 AM and after sending the message only the demolition took place.

The counter affidavit of the respondent states that the demolition was completed by 10.55 AM when a representation was filed on behalf of the petitioner. He did not notice the message when it was immediately sent.

Since the main Writ Petition is pending, this Court does not want to go into the veracity of the statement made in the Contempt Case and reserves the right of the parties with regard to demolition and the consequences of the demolition in the pending Writ Petition. In view of the doubt prevailing, the Contempt Case is closed subject to the orders to be passed in the main Writ Petition. There shall be no order as to costs.

As a sequel thereto, the miscellaneous applications, if any, pending in this Contempt Case shall stand closed.
