Heard learned counsel for the petitioner and learned Government Pleader for Revenue (Andhra Pradesh). 2.

With the consent of both parties, the Writ Petition is disposed of at the admission stage.

The present Writ Petition came to be filed seeking issuance of Writ of Mandamus declaring the endorsement in RC No.785/2017 A, dated 06.12.2017, of respondent No.4 in refusing mutation of the name of the petitioner in revenue records in respect of land admeasuring Acs.2.97 cents in Survey No.53/5 of Vizianagaram Bit I village, Vizianagaram District, as illegal and arbitrary.

It is to be noted here that the impugned order came to be passed in the month of December, 2017, giving reasons as to why the Tahsildar - respondent No.4 is not intending to mutate the name of the petitioner in the revenue records. If the petitioner is aggrieved by the said order, he has to avail the remedy available under law by filing an appeal against the said order. The issue raised requires verification on factual aspects and hence the grievance of the petitioner cannot be adjudicated in a Writ Petition filed under Article 226 of the Constitution of India.

In view of the above, the Writ Petition is disposed of giving liberty to the petitioner to avail the remedies available under law. 6.
