THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.18834 of 2015 ORDER:

The grievance of the petitioner is that the respondent - Corporation was not considering its explanation submitted pursuant to the show cause notice dated 02.02.2015. The issue relates to the appointment of the petitioner as a L.P.G. Distributor of the respondent - Corporation.

The Chief Manager (LPG-S) of the respondent - Corporation at Hyderabad filed a counter-affidavit stating that the petitioner's explanation had been received but the matter was kept pending as certain documents had been called for by the respondent - Corporation.

As the petitioner states that the explanation was submitted as long back as in February, 2015, the respondent - Corporation cannot keep the matter pending indefinitely. The writ petition is therefore disposed of directing the respondent - Corporation to consider the petitioner's explanation along with other relevant material, if any, after duly disclosing the same to the petitioner and giving it an opportunity to respond thereto, and pass appropriate reasoned orders in accordance with law. This exercise shall be completed expeditiously and in any event, not later than eight (8) weeks from the date of receipt of a copy of this order. Pending Miscellaneous Petitions shall stand closed in the light of this final order. No order as to costs.
