HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.3779 of 2015 ORDER :

This Criminal Petition is filed by the Petitioners/Accused Nos.2 and 3 under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.42 of 2015 of Women Police Station, Rajahmundry, East Godavari District registered for the offence punishable under Sections 498-A and 506 IPC r/w 34 I.P.C and Sections 3 and 4 of Dowry Prohibition Act.

2) Heard learned counsel for the petitioners/ accused Nos.2 and 3 and learned public prosecutor representing the 1st respondent - state before admission and before ordering any notice to the 2nd respondent-de facto complainant. Perused the material on record.

3) As the material falls short to the admit the Criminal Petition filed under Section 482 Cr.P.C but for the facts even to admit entitlement of bail to the petitioners, the Criminal Petition is disposed of with the following terms:

4) The petitioners/ accused Nos.2 and 3 to surrender before the learned Magistrate concerned and move for regular bail with notice to Assistant public prosecutor concerned, in such event the learned Magistrate shall grant bail on the same day with necessary conditions. Needless to say pending investigation, the personal appearance of the petitioners shall dispensed with while granting bail and the remedy if any is left open to the petitioners/ accused Nos.2 and 3 after completion of investigation.

5) Miscellaneous petitions, if any pending, shall stand closed. _________________________
