The Court made the following:
ORDER:
The petitioner is a Field Assistant. Making several allegations against the petitioner while functioning as Field Assistant, by proceedings, dated 13.10.2015, charges were levelled against him and called for his explanation and pending enquiry into the allegations, he is placed under suspension.
2. In the facts of this case, it cannot be said that the suspension is vitiated on the ground of non-application of mind or amounting to arbitrary exercise of power. When there are serious allegations levelled against the Field Assistant, it is also in public interest to remove him from the post, pending enquiry. Thus, I am not inclined to interfere with the order of suspension. However, having regard to the fact that even the Rules mandate time frame within which an enquiry is required to be completed, the Project Director-cum-
Additional District Programme Coordinator of MGNREGS, District Water Managing Agency, Srikakulam District (4th respondent) is directed to complete the enquiry and finalize the disciplinary proceedings and take appropriate decision, as warranted by law, within a period of four (4) weeks from the date of receipt of copy of this order.
3. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
