THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.19753 of 2017 ORDER:

The petitioner complains against the 2nd respondent that the 2nd respondent is not receiving the details of change in the members of petitioner Society submitted on 03-09-2016. From the material available on record, it is clear that a few changes in the members of petitioner Society have taken place and the petitioner is attempting to get the changes to the notice of the 2nd respondent.

This Court has difficulty in accepting the oral assertion of petitioner that the 2nd respondent is not even receiving the details furnished or forwarded to the 2nd respondent. To appreciate this grievance, learned counsel for petitioner requests the Court to permit the petitioner to send the changes by registered post with acknowledgment due and the intention of the 2nd respondent will be known after receiving the application. The statement is placed on record.

The petitioner is given liberty to send the changes to the 2nd respondent by registered post with acknowledgment due by enclosing a copy of this order. The 2nd respondent on receipt of such request to act in accordance with law. It is made clear that this Court has not considered the merits of the changes or otherwise

and it is for the 2nd respondent to examine and proceed in accordance with law.

The writ petition is disposed of accordingly. Miscellaneous petitions, if any, pending, shall stand closed. No order as to costs.
