HON'BLE DR. JUSTICE B.SIVA SANKARA RAO CRIMINAL REVISION CASE No.150 OF 2017 ORDER:

The petitioner is A4 of C.C.No.31 of 2014, that was taken cognizance for the offence punishable under Sections 120-B r/w 409, 420 and 477-A of IPC and Sections 13(2) r/w 13(1)(c) of Prevention of Corruption Act.

The petitioner in the course of hearing before charges filed application under Section 239 Cr.P.C. seeking to discharge him in Crl.M.P.No.596/2016 and went unsuccessful vide impugned order dated 23.11.2016 in maintaining the revision.

The contentions are that there is no iota of material against the petitioner and the learned Special Judge should have been allowed the application by discharging the petitioner/A.4 for no role of him much less to show his privy with other accused 1 to 3 and even on the face value of the material placed reliance by the prosecution with the final report for consideration from analysis, no case is made out and thereby sought for setting aside the dismissal order of the discharge application of the petitioner by allowing the same seeking to discharge.

Whereas, it is the submission of the learned Special Public Prosecutor for C.B.I. that the impugned order not only

a detailed one but also a well-considered one, no way requires interference while sitting in revision within the limited scope. 5.

Heard and perused the material on record.

In fact, a perusal of the impugned order with reference to the material for this Court while sitting in revision no way requires interference, but for to observe that the impugned order no way influence the mind of the court in ultimate trial of the case nor prejudice any defence of the accused during trial.
