THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT WRIT PETITION No. 22533 of 2016 ORDER:
Calling in question the legal validity of Notification No.G1/1954/2016 dated 30.06.2016, and challenging the action of the respondents in issuing Preliminary Notification in Form VI under Section 11(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Act 30 of 2013), the present writ petition is filed.
2. Learned counsel for the petitioner vehemently assailed the action of the respondents in issuing the aforesaid notification seeking to acquire the lands without revising and updating the market value of the lands as per A.P. Revision of Market Value Guidelines Rules, 1988, as adapted by the Telangana State vide G.O.Ms.No.96 dated 28.05.2016 and as per Section 26 of the Act 30 of 2013.
3. Learned Government Pleaders for Land Acquisition and Revenue, appearing on behalf of the Learned Advocate General for the State of Telangana, submit that the Government has decided to withdraw the impugned Notification issued in Form VI under Section 11(1) of the Act 30 of 2013.
4. In view of the submission made by the learned Government Pleaders appearing for the respondents, the cause of action in the present writ petition does not survive.
5. Accordingly, the writ petition is dismissed as infructuous. No costs. Pending miscellaneous petitions, if any, shall stand closed. ________________________ SURESH KUMAR KAIT, J 08th Aug, 2016
