THE HON'BLE SRI JUSTI CE C. PRAVEEN KUMAR W RI T PETI TI ON No.1 8 8 6 6 of 2 0 1 7 ORDER:

Heard both sides. With the consent of both parties the writ petition is disposed of at the admission stage.

2.

The present writ petition came to be filed seeking issuance of writ of Mandamus declaring the action of respondents in attempting to deny access and entry into the petitioners' land in Survey Nos.95 to 102, 106 and 107 situated at Devar Yamjal Village, Shamirpet Mandal, Medchal District by constructing a compound wall, as illegal and arbitrary. 3.

Though various grounds are raised, learned counsel for the petitioners restricts his prayer seeking a direction to the Defence Estate Officer, TS & APO Circle, Secunderabad, to dispose of the representation made by the land holders seeking access to the land, as early as possible. Learned Government Pleader for Revenue would submit that he has no objection for the same, provided the same is made and is still pending consideration. 4.

Having regard to the above, the writ petition is disposed of directing the Defence Estate Officer, TS & APO Circle, Secunderabad, to dispose of the representation dated 05.05.2017, made by the petitioners, as early as possible, preferably within a period of three weeks. As the Defence Estate Officer is not made a party, the respondents' counsel shall inform the same to the Defence Estate Officer, TS & APO Circle, Secunderabad. No costs. As a sequel thereto, Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed.

Registry is directed to communicate a copy of this order to the Defence Estate Officer, TS & APO Circle, Secunderabad. ____________________________ JUSTI CE C. PRAVEEN KUMAR 12.06.2017 vhb
