HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.9545 of 2018 ORDER :

This criminal petition filed under Section 438 Cr.P.C. by the petitioner/A.1, among four accused, in Crime No.6 of 2016 of Women Police Station, Nizamabad District, registered for the offence punishable under Section 498-A IPC and the police after investigation filed the final report, that was taken cognizance for the offence supra and allotted C.C.No.366 of 2017 pending on the file of the I-Additional Judicial First Class Magistrate, Nizamabad. 2.

Heard learned counsel for the petitioner and learned Public Prosecutor, representing the State, and perused the material on record. 3.

Non-bailable warrant issued by showing A.1 and A.4 in abscondance from the charge sheet contents including from the Investigating Officer-LW.8 stated when he went to serve Section 41-A Cr.P.C. notice, A.1 and A.4 not available and stated in abroad, thereby could not served. Now the petitioner wants to come back from Sharjah in seeking anticipatory bail. 4.

This Court is not inclined to grant, that too not even reached the country, but for to say from the apprehension if at all chosen to come police may arrest at the Airport or in transit, there shall be stay of arrest for four weeks from the date of receipt of a copy of this order. In the meantime, the petitioner/A.1 is given liberty to come down to Indian and move for regular bail by surrender.
