HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.25628 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the inaction of the respondents in considering and taking action on the representation of the petitioner dated 08.07.2016 as illegal and arbitrary.

2. Heard the learned counsel for the petitioner, the learned Government Pleader for Panchayat Raj and Rural Development and the learned Government Pleader for Revenue for the State of Andhra Pradesh.

3. A perusal of the record reveals that the petitioner is the owner of an extent of Ac.0.15 cents of land in Survey No.466/5 of Chinnadoddigallu village of Nakkapalli Mandal of Visakhapatnam District. The grievance of the petitioner is that some of the villagers are dumping waste material in his land without any right whatsoever. The learned counsel for the petitioner submitted that drainage outlets were projected towards the land of the petitioner.

4. At the time of arguments, learned counsel for the petitioner submitted that the petitioner is giving up the relief seeking removal of the sixth respondent from his post. He further submitted that the petitioner herein submitted a representation to the third respondent on 08.07.2016 requesting the Gram Panchayat to take appropriate steps against the villagers in order to protect the land of the petitioner. The only relief sought by the petitioner is to direct the respondents to dispose of the representation of the petitioner dated 08.07.2016.

Having regard to the facts and circumstances of the case, the third respondent is hereby directed to consider and dispose of the representation of the petitioner dated 08.07.2016 in the light of Section 93 of Andhra Pradesh Panchayat Raj Act, 1994, as expeditiously as possible, preferably, within a period of one month from the date of receipt of copy of this order.

6. Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
