THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.15028 of 2024 ORDER:
Seeking the Court to enlarge the petitioner/accused No.1 in S.C.No.387 of 2023 on the file of Special Sessions Judge for Trial of Offences under SC/ST (POA) Act-Cum-VII Additional District and Sessions Judge, Ranga Reddy District at L.B.Nagar, on bail, the present Criminal Petition is filed. 2.
The brief facts of the case are that on 24.02.2023, the petitioner voluntarily surrendered before the Abdullapurmet Police and stated that as the deceased was interfering in his love life with his girl friend, he murdered the deceased by taking him to the nearby bushes at the outskirts of Pedda Amberpet Municipality on 17.02.2023. Hence, a case was registered vide Crime No.119 of before the Abdullapurmet Police, Vanasthalipuram and after completion of the investigation, a charge sheet was filed vide S.C.No.387 of 2023 on the file of the Special Sessions Judge for Trial of Offences under SC/ST (POA) Act-Cum-VII Additional District and Sessions Judge, Ranga Reddy District at L.B.Nagar, for the offences punishable under Sections 302, 201 read with 109, 202 of the IPC and Section 3(2)(v) of SC/ST (POA) Act.

Heard Sri P.Prabhakar Reddy, learned counsel appearing on behalf of the petitioner as well as Sri Syed Yasar Mamoon, learned Additional Public Prosecutor appearing on behalf of the respondent-State.

Learned counsel for the petitioner submitted that the petitioner has been in judicial custody since 24.02.2023, causing difficulty to appear for his B.Tech Semester Exams. He further submitted that the petitioner needs to appear for the B.Tech supplementary Exams which commences from 23.12.2024. He also submitted that the petitioner is willing to furnish sureties as directed. Hence, he prayed the Court to grant interim bail to the petitioner for attending his B.Tech supplementary Exams.

Learned Additional Public Prosecutor has not opposed the same of granting interim bail to the petitioner for enabling him to appear for his B.Tech supplementary Exams. 6.
Considering the submissions made by the both the parties, since the B.Tech supplemenatry exams of the petitioner was scheduled from 23.12.2024 to 06.01.2025, this Court is inclined to grant interim bail to petitioner from 20.12.2024 to 10.01.2025 subject to the following conditions: i.
The petitioner shall be released on interim bail from 20.12.2024 to
10.01.2025 subject to the executing a personal bond of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties for a like sum each to the satisfaction of the concerned Jail Superintendent.
ii.
The concerned Jail Superintendent is directed to ensure that this order is complied forthwith.
iii.
The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).
iv.
Registry is directed to communicate this order to the concerned Jail Superintendent.s 7.
Accordingly, the Criminal petition is disposed of. Miscellaneous applications, if any pending, shall stand closed.
