THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.1487 of 2016 ORDER:
This Criminal Petition is filed by the petitioner-A4 under Section 482 Cr.P.C. seeking to quash the proceedings against him in Crime No.41 of 2016 on the file of Rajendranagar Police Station, Ranga Reddy District, registered for the offence punishable under Sections 448, 427, 506 and 323 r/w 34 IPC.
It is alleged that the 2nd respondent-de facto complainant purchased a land of an extent of 330 sq. yards and since then, he is enjoying the same. While so, the accused in the above crime criminally trespassed into the above land and broke the shutter locks and threatened him with dire consequences and beat his friends with hands.
Learned Counsel for the petitioner submitted that the father of the petitioner purchased the said property and the de facto complainant is interfering with the same and the father of the petitioner also lodged a complaint against the de facto complainant on 14.1.2016 and the same was registered as Crime No.40 of 2016 and as a counter-blast to the said complaint, the present complaint was lodged by the de facto complainant.
The submissions made by the learned Counsel for the petitioner clearly indicate the fact that an occurrence took place on that day. The learned Counsel for the petitioner submitted that in the complaint, it is stated as the son of Hakeem Khan participated in the above crime, whereas in the translation of the complaint it is stated as sons of Hakeem Khan.
Admittedly, the petitioner is the son of one Hakeem Khan.
Further, the investigation is at the initial stage. Therefore, this Court is not inclined to interfere with the proceedings in the above Crime. Accordingly, the Criminal Petition is dismissed. _____________________ JUSTICE RAJA ELANGO Dated: 15.2.2016 Nn
