THE HON'BLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION NO.15153 OF 2024 ORDER:

This Criminal Petition is filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') to grant regular bail to the petitioner/A.2 in Cr.No.491 of 2024 of Kollur Police Station, Cyberabad-Sanga Reddy District. The offences alleged against the petitioner are under Sections 8 (c) r/w.20 (b) (ii) (B) of Narcotic Drugs and Psychotropic Substances Act, 1985.

The case of the prosecution is that petitioner along with other accused are involved in transporting Ganja and the police seized Ganja weighing about 1 Kg 45 Grams from his possession. As such, petitioner is liable for the offences alleged against him.

Heard Sri Ravuri Sai Sumanth, learned counsel for the petitioner and learned Additional Public Prosecutor. 4.

The contention of learned counsel for the petitioner is that petitioner/A.2 is innocent and he is falsely implicated in this

case. Petitioner is the only bread winner of his family and he is in jail since 29.10.2024. Hence, prayed to grant bail to the petitioner.

On the other hand, the learned Additional Public Prosecutor opposed granting bail. He submitted that material part of investigation is completed and there are no cases pending against him. However, investigation is still in progress and requested the Court to dismiss this petition. 6.

Having regard to the submissions made and the material on record, the petitioner is in jail since 29.10.2024. The quantity of Ganja involved is intermediate and according to the prosecution nine witnesses are already examined. In view of these circumstances, this Court deems it fit to grant bail to the petitioner with the following conditions:

i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned I-Additional Metropolitan Sessions Judge at Sanga Reddy.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks, for the purpose of investigation till

filing of charge sheet, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 482(2) of BNSS (previously known as Section 437(3) of Cr.P.C.).
