HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 4956 OF 2017 ORDER:

This writ petition is filed seeking writ of mandamus declaring the action of the 4th respondent for not disposing of the objection petition dated 27.01.2017 filed by the petitioners to the application for mutation made by the 5th respondent in respect of property situated in Sy.No.529, situated at Muthangi Village, Patancheru Mandal, Sangareddy District as illegal and arbitrary. It is the case of the petitioners that the 5th respondent filed an application dated 24.11.2016 for mutation of his name in revenue records and also for issuance of pattadar pass books and title deeds in respect of land in Sy.No.529, situated at Muthangi Village, Patancheru Mandal, Sanga Reddy District in his favour. The petitioners filed objection to the application of the 5th respondent on 27.01.2017. But without considering the objection petition of the petitioners, the 4th respondent is proceeding with disposal of the application of the 5th respondent.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

As on today, no orders are passed by the 4th respondent. This writ petition is filed by the petitioners only on apprehension. Since the petitioners had already filed objection to the application of the 5th respondent and it is pending with the 4th respondent, it is for the 4th respondent to consider the same in accordance with law.

If the names of the petitioners are entered in revenue records, it goes without saying that they are entitled for notice before passing any orders on the application of the 5th respondent. With the above direction, this writ petition is disposed of. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
