THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.9468 OF 2017 ORDER:

Heard learned counsel for the petitioners/A1 to A4 of Crime No.218 of 2017, pending on the file of Rajiv Gandhi International Airport Police Station, Ranga Reddy District, registered for the offences punishable under Sections 406, 420, 120(B) r/w 34 IPC and also heard the learned public prosecutor, representing the 1st respondent - State, before ordering notice to the 2nd respondent and perused the grounds urged in the quash petition and the contents of the FIR.

When the matter is called, learned counsel for the petitioners placed reliance on the expression of the Hon'ble Apex Court in G.Sagar Suri Vs. State of Uttar Pradesh1, almost in similar facts, however, as pointed out by the learned public prosecutor, facts of each case depends upon own merits, which requires investigation, thereby, the application is disposed of, for nothing to keep pending, but for to say, pending investigation, petitioners shall not be arrested, however, it will not prevent the police to secure the presence of the petitioners/accused, as and when required, for the purpose of investigation.

Accordingly and with the above direction, this Criminal Petition is disposed of. Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
