THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.32135 of 2018 ORDER:

A perusal of the impugned notice asking the petitioner herein to remove the firepot shows that the same was not preceded by any show cause notice to the petitioner herein.

In the considered opinion of this Court, the impugned action tantamounts to violation of principles of natural justice. Therefore, this Court deems it appropriate to dispose of the Writ Petition, by directing the impugned notice, dated 19.07.2018, to be treated as show cause notice, with a permission to the petitioner herein to submit explanation within a period of two weeks from the date of receipt of a copy of this Order and with a further direction to the respondent-Municipality to consider the said explanation and pass further Orders, strictly in accordance with law. Till the said exercise attains finality, status quo, as on today, shall be maintained. Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
