Y.Srikanth Reddy, v. The State Of Andhra Pradesh,
THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER Writ Appeal No.474 of 2017 Judgment: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) This appeal, under Clause 15 of the Letters Patent, is preferred against the interlocutory order passed by the learned Single Judge in W.P.M.P. No. 8497 of 2017 in W.P. No. 6910 of 2017, dated 1.3.2017. In the order under appeal, the learned Single Judge, while permitting the respondents-writ petitioners to take out notice to the respondents by Registered Post with acknowledgment due, granted interim suspension as prayed for.
The appellant herein is the 11th respondent in the writ petition. The remedy against the ad-interim order of suspension is by filing a petition to vacate the said interim order. The appellant has, instead, filed this appeal under Clause 15 of the Letters Patent. We see no reason to exercise discretion to interfere.
Leaving it open to the appellant herein to file a petition to vacate the earlier interim order, the writ appeal fails and is, accordingly, dismissed. Miscellaneous Petitions pending, if any, shall also stand disposed of. There shall be no order as to costs. _________________________________ (RAMESH RANGANATHAN, ACJ) _____________________________ (Dr. SHAMEEM AKTHER, J) 17th April, 2017 pnb
