THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SMT JUSTICE T.RAJANI Writ Appeal No.324 of 2017 JUDGMENT: (Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan) It is brought to our notice by Sri V.Surendra Reddy, learned counsel for the 1st respondent-writ petitioner, that the appellant has also filed a petition to vacate the interim order under appeal by way of W.V.M.P.No.1144 of 2017.
As the appellant has already exercised his remedy of seeking vacation of the interim order passed by the Learned Single Judge, we see no reason to simultaneously entertain an appeal against the very same order.
The Writ Appeal is, therefore, dismissed. Needless to state that the vacate stay petition filed by the appellant herein shall be heard and adjudicated on its merits without being influenced by the dismissal of this appeal. Miscellaneous Petitions pending, if any, shall also stand dismissed.
