THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.5874 of 2013 ORDER:

The petitioner prays for the following relief: "....to issue appropriate writ, order or direction, more particularly a writ of Mandamus, declaring the action of respondents in not providing police aid in terms of the order and decree dt.31.12.2012 passed in IA.No.1451 of 2012 in IA.No.130 of 2012 in OS No.43 of 2012 by the Hon'ble I Addl. Junior Civil Judge, Rangareddy District at LB Nagar, as illegal, arbitrary, violative of Arts. 19, 21 and 300-A of the Constitution of India." Mr.J.Prabhakar, counsel for the petitioner requests to dispose of the writ petition by placing on record the stand taken by the respondent No.2.

The stand taken by the 2nd respondent is as under: "...it is pertinent to note that if the unofficial respondents violated the orders of the Hon'ble Court in I.A.No.130/2012 in O.S.No.43 of 2012 dated 14.8.2012 I humbly submit that this respondent is ready and willing to provide police aid as and when the petitioner required and if any interference the unofficial respondents herein. It is pertinent to submit that there is no specific direction in the temporary injunction order passed by the Hon'ble Court in I.A.No.130/2012 in O.S.No.43 of 2012 dated 14.8.2012 to permit the petitioner to construct a compound wall in the suit schedule land. It is humbly submitted that this respondent shall abide by the directions if any passed by this Hon'ble Court."

The writ petition is disposed of by placing on record, the stand taken by the 2nd respondent. No order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed.
