ORDER

This writ petition was filed seeking to declare the action of the respondents in not giving posting orders to the petitioner, as arbitrary and illegal. The petitioner joined as Badli Filler in the respondent-Company. Due to his family problems, he could not continue the service. Hence, he submitted a representation on 1.8.2013 to the respondents. The respondents considered the said representation, re-appointed him as Badli Filler and posted in Srirampur Area. As he was suffering from mouth cancer, he was treated from 11.9.2013 to 24.11.2013 & 24.1.2014 to 12.3.2014. Thereafter, he was cured of the disease and to that effect, medical certificate dated 14.4.2014 was issued stating that he is fit to discharge his regular duties. Pursuant to the same, the Area Medical Officer, Ramakrishnapur, sent a letter dated 22.4.2014 to the Chief Medical Officer, Kothagudem for taking action on the fitness of the petitioner and accordingly, he was examined by the Chief Medical Officer. Even after examination, no posting orders were issued.

Therefore, he submitted a representation dated 14.7.2014 followed by another representation dated 19.1.2016 and the same were not considered.

Even after granting sufficient time, no instructions were obtained from the respondents by the learned Standing Counsel appearing for the respondents.

In the circumstances, this Writ Petition is disposed of directing the respondents to consider the representations dated 14.7.0214 & 19.1.2016 of the petitioner and pass appropriate orders thereon, within a period of six weeks from the date of receipt of a copy of this order. No costs.

Miscellaneous petitions, if any, pending shall stand closed.
