THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8882 OF 2015 ORDER:

This criminal petition under Sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioner/A1 seeking bail in crime No.232 of 2012 on the file of Amalapuram Police Station, East Godavari District, registered for the offence under Sections 364-A, 384, 302, 120(B) read with Section 34 IPC.

Heard and perused.

The allegation against the petitioner herein is that he along with the other accused have kidnapped the deceased and called for ransom, and after withdrawing cash from ATM, they have killed the deceased. Learned counsel for the petitioner submits that the petitioner has not committed any offence and he is falsely implicated in the case. Hence, he requests to grant bail to the petitioner/A.1. Admittedly, the petitioner is having bad antecedents and he is having other criminal cases and if the petitioner is released on bail, there is every likelihood of tampering the evidence. Hence, this Court is not inclined to grant bail to the petitioner/A.1. The Criminal Petition is accordingly dismissed. _____________________ JUSTICE RAJA ELANGO 07.09.2015 pln
