THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM COMPANY PETITIONS No. 146, 178, 211 OF 2012, 93, 211 & 218 OF 2013 COMMON ORDER :
All these Company Petitions were filed seeking winding of the respective respondent company alleging that the said company has become insolvent and is unable to pay the debts due to the petitioners. Various amounts have been claimed. The Company Petitions underwent several adjournments. On the advent of the Notification G.S.R.No. 1119(E), dated 07.12.2006 under Insolvency and Bankruptcy Code and the changes brought in the Companies Act, 1956, the case of the respondent company had become the subject matter of IBC proceedings before the National Company Law Tribunal in CP(IB).No. 41/7/HDB/2017 and the said IBC proceedings stands concluded by virtue of the Resolution Plan submitted by one of the successful applicant M/s SREI Multiple Asset Investment Trust Vision India Fund and finally, an order came to be passed on 03.06.
2019 wherein with respect to the petitioners in the Company Petitions, as against their respective claims, the amounts were settled either paid / agreed to be paid by the proponent of the scheme as approved to in the Resolution Plan by the Resolution Professional. There being no dispute with respect to these Company Petitions, they are not required to be kept pending before this Court. Accordingly, all these Company Petitions are closed.
