HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT APPEAL No. 206 of 2016 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) This appeal is directed against the order, dated 07.06.2010, passed in W.P.No.1793 of 2007.
While allowing the writ petition, in the concluding paragraph, learned Judge observed thus:
"Hence, the writ petition is allowed. The respondent is directed to transfer the L.I.G. house allotted to the petitioner in the year 1994 on payment of Rs.1,26,840/- with interest and penal interest as per relevant condition from 01.04.2002 till the date of payment within a period of six weeks from today. In default, the allotment shall stand cancelled. There shall be no order as to costs.'
On last occasion, we directed learned counsel for the appellant to take instructions whether they are ready to allot the L.I.G house to the respondent, if she is prepared to pay the amount mentioned in the above paragraph with interest and penal interest as per relevant condition from 01.04.2002 till the date of payment. The respondent has not challenged the impugned order. Learned counsel for the respondent, therefore, submits that the respondent is ready to pay the amount as per the impugned order. In the circumstances, we dispose of this appeal by the following order:
"The appellant shall inform the respondent, in writing, within a period of two weeks from today, the amount she is liable to pay as per the impugned order. The appellant shall calculate the interest and penal interest as per the relevant condition from 01.04.2002 till the date of payment. The respondent undertakes to make the payment without prejudice to her rights and contentions and to raise dispute regarding calculation, if any, within a period of eight weeks from the date of receipt of the communication. If the payment, as aforementioned, is not made, the allotment shall stand cancelled."
Miscellaneous petitions, if any, shall also stand disposed of.
