HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.11384 of 2015

ORDER

This criminal petition under Sections 437 & 439 of the Code of Criminal Procedure is filed by the petitioner-accused seeking to grant bail in connection with Cr.No.138 of 2013 of Buttaigudem Police Station, West Godavari District, registered for the offences punishable under Sections 392 and 302 IPC.

2. Heard learned counsel for the petitioner and learned Additional Public Prosecutor.

3. It is alleged that on 15.10.2013 when the father of the de facto complainant went to his field by car, he did not return home in the evening and when the de facto complainant contacted the cell phone of his father, a stranger told that they kidnapped his father and demanded a sum of Rs.25 lakhs and on 16.10.2013, he found the dead body of his father with head injuries in the stream near their filed.

4. Learned counsel for the petitioner submitted that the petitioner was imprisoned from the date of his arrest on 25.11.2013.

5. Learned Additional Public Prosecutor opposed the grant of bail stating that the petitioner is involved in 16 cases of serious offences.

6. Considering the facts and circumstances of the case and also the antecedents of the petitioner herein, this Court is not inclined to grant bail to the petitioner. Hence, the criminal petition is dismissed. _____________________ JUSTICE RAJA ELANGO 18th November,2015 sj
