HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.24670 OF 2017 ORDER:

This writ petition is filed assailing the action of the respondents in proposing to demolish the house of the petitioner bearing H.No.3-151/B in Sy.No.509/2 to an extent of 82 cents in Temburu Road, Tekkali, Srikakulam District, without following due process of law.

It is the case of the petitioner that she purchased the schedule property in the auction conducted by the Court in E.P.No.9 of 1989 in O.S.No.32 of 1988 in the year 1990 for valuable consideration and she is in peaceful possession and enjoyment of the same. Subsequently, she constructed house property in the said land after obtaining permission from the Gram Panchayat and regularly paying house tax to the Gram Panchayat. However, the respondents are trying to demolish the structure, without following due process of law. Aggrieved by the same, present writ petition is filed. Heard learned counsel for the petitioner, learned Assistant Government Pleader for R & B for respondents 1 to 5 and Sri Ravi Cheemalapati, learned Standing Counsel for the 6th respondent.

Learned Assistant Government Pleader for R & B as well as learned Standing Counsel for 6th respondent submits that they will follow due process of law in taking action against the structures raised in the subject property. In view of the same, the respondents 3 to 5 are directed not to demolish the structures raised in the subject property without following due process of law.

With the above direction, this writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand disposed of.
