HON'BLE SRI JUSTICE C.PRAVEEN KUMAR CRIMINAL PETITION No.2300 of 2015 ORDER:

The petitioner, who is accused No.1 in Crime No. 440 of 2014 of Suryaraopet Police Station, Vijayawada City, filed the present application under Section 438 Cr.P.C. seeking release in the event of his arrest in connection with the above crime registered for the offences punishable under Sections 420, 468, 471 and 506 IPC.

The averments in the report would disclose that A.1 to A.3 are alleged to have collected an amount of Rs.1,80,500/- each from the informant and ten others by making them believe that they would provide constructed residential houses at Jakkampudi Housing Colony which is within the limits of Vijayawada Municipal Corporation. A.1 to A.3 are also alleged to have given fake receipts and fake allotment letters to the informant and others. Having regard to the said circumstances, I am not inclined to grant anticipatory bail to the petitioner. However, it is ordered that the investigating officer shall scrupulously follow the conditions stipulated in Section 41 Cr.P.C. and also the judgment of the Apex Court in Arnesh Kumar v. State of Bihar and another before taking any coercive steps against the petitioner.
