HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.32434 OF 2018 ORDER:
The present writ petition came to be filed seeking to declare the action of the 3rd respondent-Tahsildar in not considering the application dated 16.07.2014, submitted by the petitioners for mutating their names in the revenue records for the land admeasuring Ac.0.15 gts situated at Sy.No.373/1 revised Sy.No.373/1/1 and Ac.0.16 gts, situated at Sy.No.373/1/2, revised Sy.No.373/A/1/2 of Shayampet (Jagir) Village, Kazipet Mandal, Warangal Urban District, as illegal and arbitrary.
When the matter is taken up for hearing, learned Government Pleader for Revenue would submit that the application filed by the petitioners for mutation of their names in the revenue records, is not in the prescribed form as it was submitted in the year 2014 before introducing the new scheme of issuing the pattadar passbooks and as such the 3rd respondent did not pass any orders.
Having regard to the facts and circumstances of the case, the writ petition is disposed of giving liberty to the petitioners to submit a fresh application in Form 6A through Mee Seva to the 3rd respondentTahsildar, enclosing the necessary documents, seeking to mutate their names in respect of the subject lands, in the revenue records within a period of two to three weeks from today and on such filing of Form 6A, the 3rd respondent-Tahsildar, shall deal with the same and pass appropriate orders, as early as possible, preferably within a period of eight to ten weeks thereafter, in accordance with law, after giving the reasonable opportunity of hearing to the petitioner and all the concerned.
With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
