THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.11939 of 2011 ORDER:

The grievance of the petitioner in this case was that the Inspector of Police, Pithapuram, East Godavari District, had not taken any action against the Station House Officer, Pithapuram Rural Police Station, Pithapuram, East Godavari District, on her complaint dated 19.04.2011.

The case of the petitioner is that at the behest of the 6th respondent with whom she had a civil dispute, the Station House Officer, Pithapuram Rural Police Station, interfered and subjected her to physical abuse. However, the Station House Officer was not impleaded by name and the complaint filed by the petitioner also does not reflect his name.

Notice was not ordered in this writ petition which was filed as long back as in the year 2011. The complaint of the petitioner which has not been acted upon till date has therefore become stale. This Court sees no purpose served in directing any enquiry to be initiated on the said complaint at this stage, as the police personnel who were available at that point of time may not be there now. However, as the allegations made by the petitioner in her complaint are serious in nature, this order shall not preclude her from approaching the competent forum and seeking appropriate remedies in accordance with law.

The writ petition is dismissed subject to the above observation. Pending Miscellaneous Petitions shall also stand dismissed. No order as to costs.
