HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.5719 of 2016 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Learned counsel for the petitioners prays for withdrawal of the writ petition with liberty to the petitioners to take a remedy of revision as contemplated by Rule 12 of Taxation and Finance Rules framed under Section 130 of the A.P. Municipalities Act. Mr.Nimmagadda Venkateswarlu, learned Standing Counsel for the Municipality has no objection for allowing the petitioners to file revision, as aforementioned. He submits that if revision is filed by the petitioners, respondent No.4-Commissioner shall decide the same on merits in accordance with law.
The statements made by learned counsel for the parties are recorded and accepted.
Writ petition is disposed of as withdrawn with liberty as prayed. We hope and trust that respondent No.4 shall decide the revision that will be filed by the petitioners, on merits in accordance with law, after giving an opportunity of being heard to the petitioners or their representative.
Consequently, miscellaneous petitions, if any, also stand disposed of.
